La liberté à l'ère numérique

Abstract : Exercising the autonomy of one's will presupposes, on the one hand, the absence of effective constraints preventing from acting and, on the other hand, a sufficient and fair prior information. Indeed, the reduction of information asymmetry underlies many rights and freedoms. The digital revolution opens new spaces for action and expression, but can also reinforce this asymmetry in favour of the few actors able to handle the considerable masses of information that circulate there. In this article, we study the legal frameworks, under construction, of the two major objects of the digital world that are algorithmic processing and data, and study their influence on people's freedoms. We derive principles for the extension of the existing fundamental rights to the digital sphere, as well as for the creation of new, specific rights.
