L’originalité des œuvres logicielles créées par composition de briques préexistantes

Abstract : The criterion of originality is often misunderstood in the field of software works, as many legal practitioners confuse it with the criterion of novelty, or even merit. This presentation explains the differences between these notions, and proposes an operational methodology for ruling on software infringement cases, including in the case of codes resulting from the composition of pre-existing software components.
