La portabilité des données et des services

Abstract : Reducing the asymmetry between users and controllers of computerised data processing requires the creation of appropriate rights. This is the case of the right to portability for digital services. This right is both an economic right, extending the right to interoperability, and a right of individuals, aiming at enforcing their informational self-determination. Its two sources in France are, on the one hand, the General Data Protection Regulation adopted at European level, and, on the other hand, the "République numérique" act. The practical implementation of this right, by both private and public actors, is likely to reduce rent effects and promote the creation of new services.
